Copyright Infringement: How to get content removed

Copyright Infringement has become the ‘topic du jour’ for me. Thieves are usually one step ahead of the good guys, but there is strong recourse.

I’ve spoken and written about this topic, and now have some better back-up information on the preferred direct approach to compel an infringing party to remove your content from their site.

The basis for getting tough is the Digital Millennium Copyright Act, first adopted in the United States in 1998. Over time, the guidelines have been put into effect, world-wide.

DMCA Takedown Notice

This is the name for a proper request to remove content. In short, the basis for asserting your rights requires three things.

  1. You own the copyright or have the right assert infringement.
  2. The item in question is not covered by exceptions, such as Fair Use or free speech laws.
  3. The work is in digital form…
    • Text
    • Pictures, Images, & Photos
    • Video
    • Audio
    • Images found  on Social Media Sites

It is not necessary to have a registered copyright for a particular item; only that it is your original work (and you can document it).

Don’t Forget The Hosting Company

Hosting companies do not want to unknowingly facilitate copyright infringement. With proper documentation, usually the infringing party will remove the content, promptly; however, it has been my experience that notifying the hosting company will hasten the process.
